Criminal Defense and DUIs

 

When the government accuses someone of breaking or violating the law, it’s usually going to be a criminal case. Criminal cases can range from traffic crimes such as excessive speeding, reckless driving, or DUIs to felonies like arson, negligent homicide, and sex assault, and many charges in between.

A criminal conviction can have devastating consequences throughout your life; sometimes in the form of punishment by the court such as fines or imprisonment but other times as loss of employment, loss of driver’s license, a ruined reputation, or loss of constitutional rights. I specialize in all types of criminal and traffic criminal cases, but I do not handle traffic infractions.


Temporary Restraining Orders - Family Court

Conflict may be a part of life, but when someone is threatening you or your child it may be time to seek a court order. A temporary restraining order (TRO) or an order of protection can order someone to leave you alone which can include provisions for not contacting you; approaching within a certain distance of you, your home, and/or workplace; and to not threaten you, among other things. At the same time, it’s important to know what a TRO can and cannot do and what that entails for the person seeking the court order against another.

If you’ve been accused of violating a TRO that was previously granted or if someone is trying to obtain a TRO against you right now, you may very well have a defense and it’s vital to consult with an attorney early on in the process; Akamai Law handles TRO defense in addition to helping individuals attempt to obtain a TRO.

If the person you are trying to obtain a TRO against or who is trying to obtain a TRO against you is not a family or household member, but instead like a neighbor, coworker, etc., your case is likely going to be handled in the District Court where a different statute and different standards of proof are required to get the TRO.

Akamai Law handles both plaintiff and defendant cases for District Court TROs just like Family Court TROs, and similarly it’s important to consult an attorney early on in the process.


Juvenile Justice & Defense

In Hawaiʻi if your minor child is accused of a crime they will likely be seen in Family Court in a closed proceeding with different terminology and rules than “adult court”. Make sure your child is represented by an attorney who specializes in juvenile criminal law and understands the system, rights, and options your child has when going to court together.

With over 7+ years of experience in juvenile criminal defense cases, including having previously been the sole Deputy Public Defender assigned to handle all of these cases for West Hawaii at one point, I can help you help your child with their juvenile justice case.


Paternity (Child Custody) Cases

 

When two people have a child or children in common but are not married, different rights and procedures exist in the unfortunate circumstances where those people cannot amicably agree to coparent their child or children together than if the parents had been married. If your child’s other parent is not working with you to coparent your child outside of court, you may need to consider bringing what are commonly referred to as a Custody Case against them, though the name used in Hawai’i is Paternity Case as Hawai’i law requires that Paternity be established before these cases proceed to issues over physical and legal custody and/or child support.
